The NZ Permanent Residency Outline

The Permanent Residency pathway is for those who want to settle in New Zealand permanently. The rights and duties of a PR holder are predominantly akin to that of a New Zealand Citizen, though some differences remain.
To gain a PR, it is vital to have met one of five commitments to the New Zealand criteria. Commitment to the NZ criteria can be met by becoming a tax resident, by spending enough time in NZ, by owning a business, by investing in the country or by establishing a base here.

Here are the categories under which you can apply for a PR Visa:

Skilled Migrant Category (SMC)

This category is suitable for ‘skilled migrants’ who want to gain Permanent Residence in NZ, on the basis of their educational qualification and work experience.

NZ is a fantastic country, ideal for migrants who have the qualifications and skills that are in demand here. It is little wonder then that each year many thousands of migrants and their families apply to gain NZ Permanent Residence attracted to the promise of a great lifestyle!

With ongoing shortages across a number of professions including doctors, nurses, teachers, architects, IT professionals, engineers, electricians and chefs, New Zealand is constantly searching for highly skilled migrants. And, in turn providing them with a safe, secure and enabling environment to practice and hone their skills.

1. The Points System:

New Zealand follows a comprehensive points-based system to decide on an application’s eligibility. Under this system, you may be awarded points for different aspects such as age, qualifications, skills, work experience etc. And, there are additional points to be gained if you have a job offer in New Zealand, have studied or worked in New Zealand, or have qualifications, work experience or a job offer in a skill-shortage occupation. You can also claim points for your partner’s qualifications and/or offers of skilled employment, if applicable.

The system is tuned to accept applications that meet the minimum threshold within the set quota. This minimum threshold, however, is subject to change (in accordance with the Immigration Policy). The current threshold is 160 points. If you can claim 160 points, you are eligible to apply for Permanent Residency under this category.

It is important to note that location has no bearing on the system. And you can be eligible to apply irrespective of where you are located, provided you meet the minimum threshold requirement.

(a) The selection criteria under the Skilled Migrant Category are complex and processing times can range from 6-12 months. The processing times may further stretch if your application encounters difficulties.

(b) You require a comprehensive understanding of the subject to be able to answer a variety of questions such as, “Is my job offer ‘skilled’ or not?”, “Can I claim points for work experience gained in my country?” “When can I claim bonus points?”, “Is my qualification and certificate recognised in New Zealand?”, or “Does my job offer meet policy requirements?”.

(c) You may have to go through the many lists that Immigration New Zealand publishes in order to find where you stand.

(d) You need to familiarise yourself with immigration rules and concepts and analyse where you, your qualifications and your occupations fit.

Work to Residence

Residence to Work is an expedited pathway to residency. This category may be just the right choice for people with exceptional skills and talents, whose skills and talents are in great demand in New Zealand! This includes a huge base of New Zealand based employers looking for specific skills, people recruiting in niche fields such as arts and culture, people working in areas of absolute skills shortages, and religious workers and institutions. Holders of NZ Work Visas under the following categories are eligible to apply for Permanent Residency under the Residence to Work Category:
  • Talent (Accredited Employers) Work Instructions:

This policy is for applicants who have the skills required by an NZIS-accredited employer to hire overseas workers.
  • Talent (Art, Culture and Sports) Work Instructions:

This policy is for applicants with exceptional talents in arts, culture or sports who can positively contribute to the development of New Zealand in one of these fields.
  • Long-Term Skills Shortage List Work Instructions:

This policy is for applicants working in an occupation on the Long-Term Skill Shortage List.
  • Religious Work Instructions:

This policy is for applicants who are religious workers working for religious institutions and faith centres.
  • South Island Contribution Work Instructions:

This policy is specifically for applicants from the South Island. There is a stipulated set of requirements to be followed for each category in order to apply for a PR. These requirements include details such as – duration of time spent under the Work Visa, state of health, character, salary, and skill level. Special Categories

New Zealand offers a safe, inclusive and healthy environment for all migrants. And this is specifically showcased through their policies for Special Category Permanent Residency. Here, there are provisions for two distinct categories of people: (a) Refugees and (b) Peoples belonging to certain nationalities.

The Refugee Category is for people who are seeking political asylum, victims of domestic violence, people under the refugee family support category, people under the refugee family reunification category, and victims of human trafficking.
